Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) govern your use of hyperfoxonline.com (the “Site”) and any waitlist sign-up made through it. By using the Site or joining the waitlist, you agree to these Terms. If you do not agree, please do not use the Site.

2. Who we are

The Site is operated by Hyperfox LLC, a Missouri limited liability company (“Hyperfox,” “we,” “us”). Our contact details are in section 16. Hyperfox is the name of our online shop.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site, join the waitlist, or (once the store opens) place an order. The Site is intended for users in the United States and Europen Countries.

4. The waitlist

  • The Site is currently a landing page and waitlist. The online store is not open, and you cannot place orders yet.
  • Joining the waitlist is free. It creates no obligation to buy anything, and it does not reserve any product, price, or quantity.
  • We do not promise that the store will open on any particular date, or that any product or price shown on the Site will be available when it does.
  • By joining, you agree that we may email you about the store launch, as described in our Privacy Policy. You can ask to be removed at any time by emailing [email protected].
  • You must provide an email address that belongs to you.

5. Product information; independent seller and trademark disclosure

Hyperfox LLC is an independent seller of Herbalife products. Hyperfox is not Herbalife. Herbalife names, logos and other marks are the property of their respective owners. We use them only to identify the genuine products we sell. We do not claim to be Herbalife, to operate Herbalife’s own website, or to be endorsed, sponsored or approved by Herbalife, and nothing on the Site should be read that way. The Hyperfox name and fox mark are ours and are separate from any Herbalife brand.

Product names, images, categories and sample prices on the Site are for general information. Packaging shown may differ from what is sold. Information on the Site is not medical advice. Talk to a qualified healthcare professional before changing your diet or starting any new product, especially if you have a health condition, are pregnant or nursing, or take medication. Always read the label and follow the manufacturer’s directions.

6. Orders, pricing and taxes (once the store opens)

When the store opens, additional order terms will be shown at checkout. In general: prices are in U.S. dollars; prices and availability can change without notice; sales tax is added where required by law; and an order is accepted only when we confirm it or ship it. We may cancel or refuse an order, for example if a product is unavailable, a price was shown in error, or we suspect fraud, and we will refund any amount already charged for a cancelled order. Prices shown in the “Launch pricing preview” are indicative only and are not offers.

7. Shipping

At launch we plan to ship only to addresses in the United States. Shipping charges and estimated delivery times will be shown at checkout. We do not sell to or ship to any person or place that is the target of U.S. sanctions or whose purchase would violate U.S. export or trade laws. Risk of loss passes to you on delivery to the carrier’s recorded delivery address.

8. Refunds and returns

Returns and refunds for orders placed once the store opens are covered by our Refund Policy, which forms part of these Terms.

9. Acceptable use

You agree not to: (a) use the Site in violation of any law; (b) submit false, misleading or someone else’s details to the waitlist; (c) interfere with or disrupt the Site, its servers or security; (d) probe, scan or test the Site’s vulnerabilities without our written permission; (e) use bots, scrapers or automated means to submit forms or collect content, except ordinary search-engine indexing; or (f) copy, resell or republish Site content without permission.

10. Intellectual property

The Site’s design, text, code, the Hyperfox name and the Hyperfox logo are owned by or licensed to Hyperfox LLC and protected by intellectual property laws. You may view the Site and print pages for your personal, non-commercial use. All other rights are reserved. Third-party names, marks and product images remain the property of their owners.

11. Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure. Nothing on the Site is medical advice.

12. Limitation of liability

To the fullest extent permitted by law, Hyperfox LLC and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of goodwill, arising out of or related to your use of the Site or the waitlist. Our total liability for any claim relating to the Site or the waitlist will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnity

You agree to defend and indemnify Hyperfox LLC and its members, managers, employees and agents against claims, damages, losses and reasonable legal fees arising from your breach of these Terms or your misuse of the Site.

14. Governing law and venue

These Terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-law rules. You and Hyperfox agree that any dispute arising out of these Terms or the Site will be brought only in the state or federal courts located in Missouri, and you consent to their personal jurisdiction. Before filing a claim, please contact us so we can try to resolve the matter informally.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above shows the latest version. Changes apply from the date they are posted. If you keep using the Site after that, you accept the updated Terms. If a change affects how we use waitlist emails, we will tell you by email.
